Once in the shopping cart you will be able to view the list of products you have selected, detailing the unit price, quantity and total price for each item. 6.- RETURN, EXCHANGE AND REFUND POLICY
Mare Terra Coffee S.L. establishes this return policy in order to ensure transparency and quality in our business relationships with professional customers within the current legal framework in the European Union.
Scope: This policy applies to all sales of bags of green coffee, made to customers within the territory of the European Union.
NOTE 1.1: This policy serves as a way to have a documentary support to be used in case of product returns.
NOTE 1.2: Once the Customer signs the delivery note, proof of delivery, POD (PROOF OF DELIVERY) or other document similar to these and serves as proof that the order has been delivered correctly, the customer confirms that he received his order in good order and in good condition.
NOTE 1.3: Throughout this policy the following should be taken into account.European Standard Contract for Coffee (ESCC), latest edition – Hamburg.
6.1.-Right of withdrawal
NOTE 1.1.1: Consumers (B2C) have the right to withdraw from the contract without justification within 14 calendar days of receipt of the order, in accordance with Directive 2011/83/EU.
The Customer (hereinafter), as a consumer and customer, makes a purchase on www.mareterracoffee.com or through a commercial transaction with a seller. If you are not satisfied with any of the products in your order, you have the right to cancel the purchase and request a refund.

The customer must return or send the products without undue delay and, in any case, no later than within 14 calendar days from the date on which Mare Terra Coffee S.L. was informed of the decision of withdrawal.
The customer acknowledges that it shall bear the direct cost of return (transport, delivery) of the goods, should any be incurred. In addition, it shall be liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The products must be returned using or including all their original packaging, instructions and other accompanying documents, as well as a copy of the purchase invoice. In no case, Mare Terra Coffee S.L.. will accept as returns those products that are unsealed or unopened.
Exceptions to the right of withdrawal, by way of example, and not exhaustive, this would be the case of:
The right of withdrawal does not apply to the delivery of:
- Products that do not allow their return due to hygienic or health protection reasons, if they have been unsealed, un-palletized after delivery, or if they were, after delivery, inseparably mixed with other products;
- Products that may deteriorate or expire quickly;
- Have deteriorated after delivery due to improper storage conditions;
In any case, no refund will be made if the product has been used beyond the mere opening of the product, of products that are not in the same condition in which they were delivered or that have suffered any damage after delivery.

6.2.-Return of defective products or shipping errors
These are all those cases in which the customer considers that, at the time of delivery, the product does not conform to what was stipulated in the contract or purchase order, and therefore, should contact Mare Terra Coffee S.L.. immediately and let you know of the existing non-conformity (defect/error) by the same means or using the contact details provided in the previous section;
The customer may request a refund in the event that:
- Product received does not match the contract (e.g. variety, number of bags, lot).
- The product shows visible damage at the time of delivery.
- The Coffee presents quality defects attributable to the origin process (according to quality control and cupping protocols).
For this purpose, the following conditions must be met:
- Mandatory notification within 28 working days of receipt of the product.
- Sending evidence (photos of the product, copy of the BL if any, copy of invoice, etc.).
- Tasting report if the claim is for sensory defect.
- Counter-sample
Mare Terra Coffee S.L.. will inform you on how to proceed with the return of the products, and these, once returned, will be examined and the customer will be informed, within a reasonable period of time, if appropriate, the refund or, where appropriate, the replacement of the same.
The general steps to follow are;
- Contact in writing via official e-mail info@mareterracoffee.com indicating the order and invoice number, date of receipt, affected product and detailed description of the problem.
- Mare Terra Coffee S.L. will evaluate the claim within a maximum period of 10 working days.
- If approved, it will be agreed with the customer:
- Product replacement (subject to availability), or
- Credit note for the corresponding amount, or
- Partial or total reimbursement, as the case may be.
The amount paid for those products that are returned because of a defect, when it really exists, will be refunded in full, including delivery costs and costs incurred by the customer to make the return. The refund will be made by the same means of payment that the customer used to pay for the purchase.
NOTE 6.2.1: No returns of opened bags (unless quality problems or breakage due to mishandling is proven, must be stated on the POD), tampered with or without their lot number visible, will be accepted.
NOTE 6.2.2: The transport costs for the return will be borne by. Mare Terra Coffee S.L. only if the error or defect is attributable to the company.
NOTE 6.2.3: In no case will returns be accepted without prior written authorization.
6.3.-Product warranties
The customer, as a consumer, enjoys guarantees on the products that can be purchased through this website or under direct sale with the seller, in the terms legally established for each type of product, counting from the date that appears on the receipt or invoice of purchase, or on the delivery note if the delivery is later.
In this way, it is understood that the products are in conformity with the contract provided that: they conform to the description made by Mare Terra Coffee S.L. and possess the qualities presented therein, are suitable for the uses for which products of the same type are normally intended; and present the usual quality and performance of a product of the same type and which are essentially to be expected of it. When this is not the case with respect to the products delivered to the customer, the customer shall proceed to report defective products or products that were delivered in error.
The warranty period does not include deficiencies caused by negligence, blows, incorrect use or improper handling, etc., or materials that are worn out due to use. In the event of a defect caused by misuse, the repair will be billable upon quotation.
In those incidents that justify the use of the warranty, we will opt for the replacement of the item or return, under the terms established by law. Exchanges or refunds will be made provided that these two conditions are met:
Prior notice is given to Mare Terra Coffee S.L. within 20 working days. This step is essential regardless of the reason for the return. You may do so by sending an e-mail to info@mareterracoffee.com attaching a copy of the invoice and order number in the subject line of the email. Mare Terra Coffee S.L. will tell you how you can act for the return of the article.
Failure to comply with the one-month deadline shall not entail the loss of any right to compensation, the customer being liable, however, for any damage or loss actually caused by the delay in communication.
Under Royal Legislative Decree 1/2007, the seller is obliged to deliver to the consumer a good that is in conformity with the contract of sale under the terms established therein (article 114), whereby:
“The seller is obliged to deliver to the consumer and customer products that are in conformity with the contract, being liable to him for any lack of conformity that exists at the time of delivery of the product”.
The computation of the warranty will begin on the same day of purchase, pursuant to the aforementioned article 123 of the Royal Legislative Decree 1/2007.
6.4.-Logistics and additional conditions
- Returns must be arranged with prior written authorization.
- Unannounced or late returns will not be accepted.

7.- PARTIAL NULLITY
If any part of these terms of service is unlawful and therefore invalid, this shall not affect the other provisions which are in accordance with the law. 8.- MODIFICATION OF PURCHASE CONDITIONS

APPLICABLE LAW
